Die private Widmung

By opening a property to public access, a »semi-public« or »publicly accessible« space is created. A property owner and possessor may open or close this space at will. Whether such a space can be opened to the public subject to binding conditions enforceable against third parties, and whether violations of those conditions can be restrained under § 1004(1) sentence 1 of the German Civil Code (BGB), has become a matter of doctrinal debate, particularly in connection with prohibitions on photography and filming.
Taking this controversy as its starting point, Bettina Rentsch examines the doctrinal, theoretical, and historical foundations as well as the limits of a central private-law instrument for regulating publicly accessible spaces, reflected in the title of the work: private dedication (private Widmung). Her analysis operates at several intersections. From a doctrinal perspective, she explores the boundary between legal transactions and proprietary injunctive protection, demonstrating that private dedication is rooted both in the allocative content of property ownership and in the principles of legal-transaction doctrine. From the standpoint of normative theory, she investigates the relationship between private and public norm-making and develops criteria for the legitimacy of private norms. From a constitutional perspective, she highlights the role of publicly accessible spaces in enabling the exercise of fundamental rights, both within and beyond frameworks of direct and indirect constitutional rights obligations.
Methodologically, the author undertakes a contemporary historical and foundational reconstruction of private dedication. In pursuing this inquiry, she finds support in the law of property in the strict sense, particularly §§ 93 ff. and §§ 946 ff. BGB. In legal practice, the creation of proprietary »functional units« is understood to rest on a natural act of volition, one that encounters its internal limits in third-party interests and prevailing social understandings. From this, the study derives the cornerstones of a general doctrine of private dedication in publicly accessible spaces.
