No economic resource is as strongly regulated as the private ownership of land, and this is why urban land use law has turned into a laboratory for 'alternative' legal instruments in conformity with market conditions. Christian Schubert develops a concept for an alternative Law and Economics approach which is compatible with evolutionary insights into the nature of urban change and is based on the social contract model. He studies those rules of urban change which can attain general consent as well as those constitutional procedures with which such rules can be created. The main question turns out to be how the positive and normative governance knowledge required to regulate urban change can be generated and processed. The goal is to develop a practical social technology of legal economics in order to conduct a reform of legal governance methods.
