Jörg Dilger retraces the evolution of the »new« EU matrimonial regulation which is going to replace the »old« regulation (EC) No. 1347/2000 (Brussels II Regulation) as of March 1st 2005. He compares the jurisdiction criteria, the different bases for jurisdiction as well as the lis pendens rule stipulated in the regulation. He then questions whether, considering the principle of non-discrimination embodied in Art. 12 of the EC Treaty, nationality and domicile can still be jurisdiction criteria in an EC regulation.
