Die zivilrechtliche Haftung des Strafverteidigers

Kerstin Schlecht studies whether or not a defense attorney can be made liable for damages in the case of irregular conduct. In order to do so, she begins with a list of the defense attorney's duties. She shows that, unlike the attorney who works on civil law cases, the defense attorney is not bound by the instructions given by his client, but that apart from this the duties of an attorney working on civil law cases are basically applicable to the defense attorney as well. In her book, the author also focuses on issues pertaining to damages and causation. She shows that a damage can basically be seen in a penal sanction irrespective of the client's guilt and that problems in the hypothetical criminal proceedings do not stand in the way of determining the damages.
