Erkenntnis, Rechtserzeugung und Staat bei Kant und Fichte

Jens Eisfeld examines the teachings of Immanuel Kant and Johann Gottlieb Fichte on the theories of law and state as well as the epistemic foundations thereof. As to the epistemic foundations of the Kantian philosophy of law and state, this study reveals the fundamental importance of the two-worlds-theory which holds that besides the world of experience an independent or rather subject-independent world of »things in themselves« exists. While Kant develops his philosophy of natural law on the basis of the two-worlds-theory, Fichte combines the two worlds of experience and of things in themselves, thereby uniting the factual authority of law and the epistemic validity of law in a theory of legal positivism.
