Johannes Ady examines the compensation for immaterial damage, the amounts of which vary considerably in the various European countries and in the U.S. and attempts to explain these methodically. He begins with a description of the current legal situation as well as the amounts of damages awarded in selected legal systems, focuses on the differences and common ground in these legal systems and develops case types. He then examines the criteria for estimating the amount of the damages. He establishes criteria from the German and other legal systems, from various theories and judicial decisions, and shows alternative methods of estimating damages which were developed as part of this doctrine. In conclusion, the author gives a critical assessment of the amounts of damages in Germany and discusses possible changes.
