Summary
The efficiency of the Single European Market has been reduced by the differing regulations regarding defective quality contained in the laws on the sale of goods in the Member States. Andreas Schwartze gives a detailed functional comparison of the remedies for defective goods in all 15 legal systems of the European Community. He develops a basis for a European law on the Sale of Goods and proposes a convention among the Member States of the EU. This convention would not be mandatory, but could be chosen by the parties to a domestic sales contract in place of the national law on the sale of goods.
