Europäisches Verfassungsrechtsdenken

Claudio Franzius questions how European constitutional law can be conceived on the basis of the Lisbon Treaty. What are the factors that define the European Union as a community governed by the rule of law? Which key questions can be formulated in the European concept of the constitution? Does it really make sense to continue looking for common values and a European identity in the process of European unification? The main emphasis here is not on a comparison of legal systems for the ius europaeum publicum which is in a development process but rather on a reconstruction of the open relationship between the law and politics on the European level. The author provides a critical analysis of decision made by the German Federal Constitutional Court regarding the Lisbon Treaty and studies the European constitutional principles.
