In view of the increasing harmonization of private law within the European Union, one may ask whether the development of common enforcement mechanisms throughout the union is expedient. Existing legislation in the area of civil procedure maintains a particular focus on the enforcement of intellectual property rights.
By using the example of industrial property, Ruth Janal demonstrates current obstacles to the harmonization of civil procedure and explains the potential effect of EU rules on transnational civil procedure. The author also offers an introduction to the Unified Patent Court´s rules of procedure.
