Summary
For over a century, German courts have assumed that the executive branch voluntarily complies with court decisions issued against it. However, several recent cases have questioned this premise, with the executive branch repeatedly and overtly defying court orders. Philipp Koepsell examines how the rule of law can prove resilient in the face of governmental disobedience, drawing a comparison with U.S. contempt sanctions in particular.
