The state finds itself in the dilemma of facing more difficult challenges although its operating effectiveness is dwindling. The attempt to cut back on governmental institutions has resulted in privatization on all levels. Functional privatization is characterized by the fact that the preparation and/or the implementation of the task is transferred to private persons while the state retains responsibility for the performance of the task. In this work, Martin Burgi examines numerous questions of constitutional law in regard to the circumstances and the feasibility of functional privatization and above all in regard to administrative assistance and in doing so develops new standards for implementing public law under altered conditions.
