Constitutional courts in Europe increasingly use the concept of constitutional identity. Kassandra Wetz elaborates on the functions of this concept by analysing the case law of the constitutional courts in Germany and five other Member States of the EU. Based on this, she demonstrates that the European Court of Justice uses a similar concept of constitutional identity in the European Union itself.
