Grenzüberschreitende Beweisaufnahme im Europäischen Justizraum

Achim Müller examines the various possibilities of taking evidence required for civil law proceedings in foreign jurisdictions within the European Union. He focuses his attention on regulation no. 1206/2001, which took effect on January 1, 2004. He describes the interests of the various parties concerned in cross-border taking of evidence and does a comparative study of the English, German, French and Danish laws pertaining to the procedure of taking evidence. In addition, the author develops standards for evaluating the regulations in the E.U., focusing on the obligation of the persons involved, an issue which up to now had seldom been addressed. He concludes his work with a summary of potential and desirable developments.
