Grundrechte und Privatrecht aus rechtsvergleichender Sicht

The relationship between fundamental rights and private law has become a key subject of discussion in international jurisprudence. An example of this is the Ibero-American legal circle, which has partially latched on to the German discussion regarding the effect of the basic constitutional rights between private parties but which is at the same time pursuing its own course and has been influenced by very differing legal and theoretical prerequisites. The authors of this volume go beyond the boundaries of the national discussion and examine the problems from the standpoint of comparative law, along with the foundations in legal history and legal theory. They provide analyses from Brazil, Portugal, Spain and Germany as well as special articles on consumer protection, wrongful life, fundamental rights in labor law, European freedom of establishment, protection against discrimination as well as effective legal redress.
