Summary
Jens Adolphsen examines the possibility that athletes making use of their right to seek legal protection from state courts could prevent international athletic associations from enforcing uniform doping penalties. Based on a comparison of the laws in Switzerland, Germany, the U.S.A. and Europe (among others), the author asks if state law in general is responsible for the failure to enforce penalties, since it may not be able to cope with the phenomenon of global sport.
