Cross-border consumer contracts are becoming more common in the era of the Internet. The question of what court decides and what law applies is of special importance for consumers who are generally less experienced in international contracts and have less bargaining power. Niklas Ganssauge shows that under European law a consumer can rely on his home jurisdiction whereas under American law he is usually subject to unfavorable forum selection clauses. Similarly, the European consumer is generally protected by special conflict of law rules whereas only very few such rules exist in American law.
