Oligopolies have always been a problem for Antitrust. In addition to examining whether or not the European competition authorities and the courts have been able to solve this problem using the theory of collective market dominance, Marc Amstutz proposes an evolutionary alternative to traditional law and economics. With the use of evolutionary arguments in particular he attempts to show ways of making the present line of reasoning in competition law, which is still static, more dynamic.
