The mobility of labor is both a result and the driving force behind globalization. However, few countries are presently seizing the opportunity to reform their migration policy and profit from lower mobility costs. Sara Borella analyzes migration policy in Germany and the European Union and discusses the characteristics of desirable rules for the movement of workers from the perspective of constitutional economics. The negative demographic development and labor market shortages are typical of democracies in western Europe, which need to attract skilled immigrants and are in competition with one another. Thus what is needed is not a harmonized EU common migration policy for economic migration, nor is a point system which is designed to be a hurdle for potential highly skilled workers required. Economic migration rules should allow for competition between jurisdictions in accordance with the appropriate rules and at the same time respect the common interests of the members of each jurisdiction.
