Missbrauch der Vertretungsmacht

German law explicitly distinguishes between the scope of an agent's authority to act on behalf of his principal and the instructions given by his principal which determine his internal duties. The author explains why the scope of the agent's authority typically goes beyond the internal restrictions set by the agent's duties to his principal. The reasons given by the author show under which circumstances the principal should be allowed to raise a defence against the contract if the contract is entered into by an agent acting within his authority but in breach of his duties to his principal. Although the book explicitly only refers to German law, its results deserve consideration in all legal systems accepting agency.
