Current basic law in Germany is lacking in sustainability, something not least revealed by representative democracy's tendency to forget the future. Wolfgang Kahl analyses various options for reforming legal policy with a view to both the theory and practice of introducing more constitutional sustainability. He specifically pursues the question of what benefit a body of independent experts with participatory rights in the legislative process as well as the development of sustainability testing as part of regulatory impact assessments might bring.
