Alexander Kronenberg addresses the concept of the substantive law level consideration of foreign overriding mandatory provisions and shows that the need for this concept follows not only from Art. 9 Rome I Regulation but also from fundamental rights considerations. This is followed by an in-depth analysis of the solutions developed by German case law prior to the Rome I Regulation. Those solutions which are transferable to the Rome I Regulation are developed further into an overall concept of substantive law consideration.
