Summary
In German social security law there are many forms of standard setting by the executive which transcend the traditional regulatory instruments. This kind of administrative legislation now regulates matters of considerable importance. For example, the treatment of patients by the medical professions is to a large extent governed by administrative legislation rather than by parliamentary statutes. From a constitutional point of view, the admissibility of this state of affaires is doubtful, since according to a ruling by the German Federal Constitutional Court anything which is of fundamental importance must be regulated by parlamentary statute.
