Summary
Path dependence or path dependency is a widely used concept in the social sciences. Nico Schröter investigates whether the concept can also be used to explain legal phenomena. He finds that path dependence can particularly explain much about how informal legal rules (e.g. doctrinal rules) emerge and why they develop in certain ways.
