After introducing the reader to the German product liability law, she examines who is responsible for the consequences of defective software transferred through the Internet only. She then outlines the private international product liability laws in Germany and Switzerland and in the Hague »Convention on the Law Applicable to Products Liability,« and describes the effects on the determination of the law applicable to software transferred via the Internet only according to the different approaches. In conclusion, the author outlines the solutions provided by the Rome II Directive and its consequences for software transferred via the Internet only.
