Summary
Punitive and multiple damages are legal instruments which under certain circumstances enable American civil courts to order the party who has caused the damage to pay an amount exceeding the usual compensation for damages to the injured party. Dirk Brockmeier analyzes the compatibility of American punitive and multiple damages with the German ordre public in civil, exequatur and legal assistance proceedings. He combines the various proceedings to form a closed system which illustrates how German courts and authorities deal with punitive and multiple damages. In order to put this into more concrete terms, he applies the results obtained to the American RICO-Act.
