The abuse of law is a paradox: It is necessary to consider legal acts illegal.The binary distinction lawful/unlawful is applied to itself. The concept of abuse indicates antinomies within the legal system that can only be solved at the price of negative self-reference. Analysis of private law, European, and antitrust law cases prove that abuse is connected to self-contradictory behaviour.
