Rechtsvergleichung im Völkerrecht

This book investigates comparative law's relevance to the development of international law, particularly the way it functions when it comes to designing and applying international treaties, determining customary law, and ascertaining general principles. Based on a broad assessment of decision-making practices of various international courts as well as on selected works of the International Law Commission, the author lays the groundwork for a methodology for comparative analyses in international law. This study is based on the assumption that methodologically guided comparative legal analyses can contribute to promoting international law's coherence and effectiveness, mainly by increasing the rationality, clarity, and legitimacy of international treaty-making and judicial decision-taking.
