The authors of the articles in this volume deal with the regulatory issues in the different sectors (such as financial, energy, telecommunications, transportation and postal services markets) on the basis of history, economics, constitutional and Community law and establish structural similarities as well as differences.
Jurisprudence and legal practice are concerned with regulatory issues in energy, telecommunications, transportation and postal services. The regulation of financial markets has been receiving more attention recently, and similar questions are being raised in relation to the media, the public water supply, waste management, health care and even institutions of higher education. The authors of the articles in this volume analyze the regulatory issues in the individual sectors on the basis of history, economics, constitutional and Community law and establish structural similarities and differences in cross sectional chapters. It becomes apparent that regulatory law is an independent sector of the law, it is to be set apart from industrial law and cartel law, and it transcends branches which are dependent on networks. This perspective offers new opportunities in legal policy to achieve effective and legally sound regulation.
