Over the years since the first edition, regulatory law has continued to develop and differentiate itself as a distinct field of legal scholarship. The new edition, in which Jens-Peter Schneider has succeeded Matthias Ruffert as co-editor, reflects this remarkable dynamism. All contributions dealing with individual regulatory sectors have been thoroughly revised and updated to reflect current legislation, case law, and academic debate. In addition, a new chapter on digital platforms and intermediary services introduces a sector of considerable societal and scholarly relevance.
Among the most significant innovations are the extensively updated and, in some cases, substantially revised or expanded cross-sectoral chapters in Parts I and III. Section 1, on regulatory law in the United States, provides a comprehensive analysis of recent U.S. Supreme Court case law that calls into question key elements of the doctrine of independent regulatory agencies. Building on this discussion, the newly added chapter in organizational law examines the independence of regulatory administration under European and national law (§ 17). In Section 3, on regulation and freedom, the discussion of civil liberty as political liberty has been considerably expanded and further developed conceptually. Following a change of authorship, Section 4, dealing with the concept of regulatory law, has been completely restructured and given a fresh perspective. Finally, the dynamic nature of regulatory law becomes particularly evident in the comprehensively revised chapter on its instruments and procedures (§ 16).
