In decades of case law, the Federal Constitutional Court has developed and sharpened its reservations with regard to a review of competences (ultra vires), to the preservation of essential standards of fundamental rights (Solange II) and to the constitutional identity. But is the dogmatic concept of residual powers regarding European law convincing? What realignments are required?
