Summary
Discretion is omnipresent in the law. It makes the law flexible, does however impair its regulatory powers. Using Robert Alexy's principles theory, Matthias Klatt and Johannes Schmidt study the discretion given in balancing principles. In doing so, they focus on epistemic discretion which originates in the tentativeness of knowledge.
