Summary
It is common ground that licences have to be protected in case the underlying IP-right is subsequently transferred or licensed to a third party. Whereas the existence of such protection is stipulated by both the separate specific IP-statutes and the EU regulations on uniform IP titles, all these sources are silent on the legal technique how this protection is actually achieved. In her treatise covering all types of IP Lea Tochtermann analyses the effects the relevant statutory provisions have on the different types of transactions concerned, and also considers their practical implications in international cases.
