Summary
Legal positivism is questioned by experiences of unlawful law which should not exist if one had strictly insisted on this position. But it is not least the totalitarian systems of the 20th century which provoke the question of the boundaries of law that arose in other epochs as well. In this respect, the submitted volume »Unlawful Law« enters new grounds by examining the question of the boundaries of law for judicial decision-making and executive administrative actions beyond the legal-philosophical discussion of the Kelsenean normative logic which focuses on legislation alone.
