A market-oriented insolvency law should aim to prevent the liquidation of viable companies. To achieve this, it must offer an effective legal framework for corporate restructuring. Through a comparative analysis with two Greek restructuring procedures, Natalie Papadopulou evaluates whether the insolvency plan procedure under German law fulfills the criteria for an effective legal framework.
