Verantwortung

Jan Henrik Klement shows that responsibility is not a new basic concept in public law, but that it can be traced back to well-known basic concepts such as permission, duty, jurisdiction, competence and authority. Responsibility is however a concept which bridges the gap between these formal categories, as its content also bridges the gap between the law, morals and politics; it can also serve to cover up the boundary between factuality and normativity. Among other things, the author deals with responsibility in police law, product liability, personal responsibility in municipal self-government, in responsibility for the environment, ensuring liability, responsibility for public welfare, the discourse on the sharing of responsibility in administration and with government responsibility. The analysis of the functions of the concept of responsibility in the dogmatics of basic rights is one of his main subjects.
