Anton Ederle discusses the applicability of domination agreement law on frequently encountered in personam concessions of influence. He places the issue in the wider context of German corporate group law before distinguishing between subordination of management and mere concession of influence. As a result, he argues that only the complete concession of all administrative rights justifies the application of domination agreement law, which is why only such contracts are rightly called »Hidden Domination Agreements«, whereas contracts granting merely partial influence are subject to standard company law and law of obligations requirements.
