What role does housing play in inheritance law? Denise Wiedemann combines social history, social psychology, comparative law, and German legal doctrine to show why the home has long received little special attention in German inheritance law.

Denise Wiedemann explores the individual and social meanings of housing and their reflection in inheritance and matrimonial property law. She combines insights from social history and social psychology on the changing significance of housing with accounts of legal developments in foreign jurisdictions and contrasts them with key doctrinal choices in German law. Methodologically, the author demonstrates how extra-legal knowledge can do more than merely inform legal policy debates or be supplemented by comparative-law observations; it can also lead to deeper questions about legal doctrine, its underlying structures, and the forces that drive or resist change. Accordingly, the study's findings operate on several levels. The stronger emphasis on individual rather than collective experiences of housing in the process through which insights from social psychology were received and translated into legal policy contributed to the fact that, particularly in German inheritance law, the home was initially not accorded any special significance. From a doctrinal perspective, Denise Wiedemann reconstructs the principles of equal treatment of assets and of the state's neutrality in matters of inheritance as factors explaining the greater resistance of German inheritance law to societal change.
