Pre-contractual negotiations cannot be taken into account in the interpretation of contracts in English law as they can in German, French and Common European Sales Law. This is despite the fact that their admissibility may not only affect the resolution of particular disputes and the way parties draft their contracts in general, but also the judge's role in the interpretation process.
