 In order to align criminal punishment with the legal system as a whole, it is convenient to use blanket clauses and normatively loaded elements in the penal statute. This is only permissible within the boundaries of the principle of legality (»nulla poena sine lege«) in Sec. 103 (2) of the German Basic Law. The present treatise develops a framework to interpret this principle in accordance with other layers of the law in today's complex and interwoven information society.
