Summary
According to the well-established jurisprudence of the German Federal Constitutional Court, restrictions to basic rights are permissible if the relevant rights conflict with the basic rights of others or with basic constitutional principles. Sebastian Lenz questions this jurisprudence. He proposes that restrictions are permissible only to ensure the minimum necessary standard derived from the guarantee of human dignity.
