Vorbehaltlose Freiheitsrechte

A number of basic rights protected by the German Basic Law are formulated in very strict terms. Judging from their wording, these rights, such as the freedom of art and science or the freedom of religion, cannot be restricted by or pursuant to statutory law. According to the well-established jurisprudence of the German Federal Constitutional Court, restrictions are nevertheless permissible if the relevant rights conflict with the basic rights of others or with basic constitutional principles. Sebastian Lenz questions this jurisprudence. Having analyzed the Federal Constitutional Court's decisions, he proposes a new reading of the respective basic rights based on their meaning and function.
