Wehrhafte Demokratie

The principle of the »defensive democracy« is a controversial element in the German constitution. Following the predominantly politically-motivated conflicts surrounding its function and its scope, legal literature in the past years shows that there has been a decline in interest in the possibility of a democracy to defend itself. In connection with the discussions on security after the terrorist attacks on September 11, 2001 and the controversy surrounding the proceedings to ban the National Socialist party in Germany, the general public has once again become aware of the concept of a defensive democracy, and it has become a subject of scholarly interest.
