Criminal law encounters difficulties when trying to cope with economic crime in criminal proceedings. This is an expression of a more fundamental problem: the control or regulation of economic activities by criminal law in a society which differentiates among different communicative networks.
Hans Theile studies the enforcement problems in the law relating to economic offenses which occur in criminal proceedings from the perspective of the systems theory by using the concept of the systems theory for an analysis of issues in criminal law. In doing so, he combines the dogmatics and the empiricism of criminal proceedings. The author concludes his book with an outline of the legitimation prerequisites and the concepts for criminal proceedings which could constitute a more suitable form of regulation for a society which differentiates among different communicative networks.
