Personnel control is always also indirect control of academic performance. In general, therefore, service law plays a central role in the overall structure of higher education law. The science system is therefore dependent on its personnel and their individual willingness to commit themselves to the common project of science. Academic appointment procedures, in which a university recruits its professors, are therefore of crucial importance. This raises not only practical problems, but also legal issues. This article examines the legal requirements for a substantive selection decision on applications for professors.
