Das Recht der öffentlichen Wiedergabe in der Rechtsprechung des Europäischen Gerichtshofs

Contrary to the completely harmonized reproduction and distribution rights, the right of communication to the public is multifaceted and has been given a different for authors and for owners of related rights, respectively. The present article analyses the recent decisions of the CJEU concerning the interpretation of the right of communication to the public. Not all of the criteria most recently developed by the CJEU appear convincing. Neither the condition that the public be receptive nor the profit-making purpose pursued by the user is suitable in order to define the scope of a communication subject to copyright. The CJEU's discrimination between the exclusive right of authors and the right to equitable remuneration of performers and phonogram producers appear the least comprehensible. It will have to be seen whether the CJEU will further pursue this erroneous approach. However, one can certainly conclude at this point that the court is inclined to abandon some wrong paths. The recent judgment in ITV Broadcasting / TV Catchup of 7 March 2013 appears as a U-turn in some respect; at least the CJEU has explicitly rejected the user's profit-making purpose as a criterion. In the author's view both terms »communication« and »public« should have the same meaning for copyright and for related rights. Im Gegensatz zu dem Vervielfältigungs- und dem Verbreitungsrecht, die vollständig harmonisiert wurden und gleichermaßen für Urheber und Leistungsschutzberechtigte auf EU-Ebene bestehen, ist das unionsrechtliche Recht der öffentlichen Wiedergabe uneinheitlich. Es ist in verschiedenen Richtlinien geregelt, hat nicht den gleichen Umfang im Urheberrecht einerseits und im Bereich der verwandten Schutzrechte andererseits und besteht entweder als Ausschließlichkeitsrecht oder als Vergütungsanpruch. Die bisherige Harmonisierung ist zudem unvollständig, da sie nicht jede Verwertung eines geschützten Werkes in unkörperlicher Form erfasst. Der vorliegende Beitrag untersucht die neuere Rechtsprechung des EuGH zur Auslegung des Rechts der öffentlichen Wiedergabe und die Folgen, die sich hieraus auf nationaler Ebene ergeben.
