Wege zu einem Bürgerlichen Recht der Kryptowerte

Besides the pressures of international jurisdictional competition, one only has to look at the vast body of legislation from the European Commission and national regulation regarding digital assets to see that Bitcoin, Ethereum, and other tokenized assets must be granted the same private law status as physical property (Sachen). Having established the doctrinal basis for this equivalence in a previous contribution (AcP 224 (2024), 477), this article develops proposals for legislative amendments across property law, enforcement, and private international law.
