Credit bureaus occupy a modal-structural position of power, as scoring procedures shape social inclusion and reproduce inequality. Drawing on Digital Constitutionalism and a systematic analysis of German case law, this article examines the CJEU's interpretation of Article 22(1) GDPR, under which external credit scoring constitutes automated decision-making where a third party »draws strongly« on the score. Distinguishing four lines of case law, we propose an alternative interpretation: Article 22 GDPR establishes a predictive standard addressing the risk that credit scoring unduly restricts social participation.
